Purchases from WOOLTON & HEWITT and use of our website are subject to the following sales and general terms and conditions.

Section 1: Definitions

1.1 "We" | "Our" means WOOLTON & HEWITT, 9 Lower Kings Road, Berkhamsted, Hertfordshire, HP4 2AE, United Kingdom.
1.2 "You" | "Customer" means the person who's name appears on our purchase and/or service Order/Invoice/Receipt.
1.3 “Goods” | "Items" means the rings or jewellery or any part thereof that you purchase from us as set out in the Order document.
1.4 “Services” means the services (for example, re-sizing or repairing) that we have agreed to perform on goods in your ownership.
1.5 "Britain" | "British" means any location within England, Wales, Scotland & the Isle of Man. "NI" means Northern Ireland.
1.6 "Overseas" means not within Britain and NI as defined in paragraph 1.5.
1.7 "Website" means https://www.wooltonandhewitt.co.uk


Section 2: Highlights

2.1 Your goods will be made specially for you so orders cannot be cancelled nor goods returned unless faulty.
2.2 Our delivery targets are estimates; if your Special Day is within eight weeks please ask us for a firm delivery date.
2.3 Dimensions of goods (e.g. widths, depths, sizes) are subject to tolerances that are standard within the jewellery industry.
2.4 We offer free delivery to British addresses. For other destinations please check that we can deliver to you and the price.
2.5 Payment can be made by debit or credit card via our website, or by bank transfer.
2.6 The decision on ring size is yours; we offer a ring sizer service and advice.
2.7 Rings of complex design, and those set with diamonds, may have to be re-made rather than simply re-sized.
2.8 If you are allergic to any type of metal please let us know before you order.
2.9 Post-production engraving will be more costly than when specified with a new ring.
2.10 Delivery shall be
evidenced by a record made at the time by the delivery person, see 3.2.7 for full details.
2.11 It is inevitable that rings and other jewellery will scratch, mark, and change shape due to wear and tear.
2.12 For diamond and gem set goods we recommend regular inspection of the settings by a jeweller.
2.13 Our 10 year warranty covers manufacturing defects but not wear and tear.
2.14 The precise colour of precious metals cannot be shown accurately on a website or by replicas.
2.15 Overseas customers should expect to pay import duty, local taxes and fees (see your local Customs Authority).



Section 3: Sales Terms & Conditions

3.1 Contract Agreement

3.1.1 All prices are per item (unless otherwise stated) and shown in Pounds Sterling (GBP).

3.1.2 Please read these Terms & Conditions before clicking an "Add to Basket" button or otherwise placing an order; completion of the online buying process, indicated by completing the PayPal payment process or making payment or part payment in any other way, shall be deemed as acceptance of these Terms & Conditions in full.

3.1.3 All of our goods and services information including prices, provided via our website, quotations, order forms, emails, or other means, are an invitation to treat. Orders and payments are subject to our acceptance which we signify with a written "Order Confirmation". We reserve the right to accept or decline any order (in whole or in part) at our discretion.

3.1.4 The Order document that accompanies our Order Confirmation shall be the definitive, complete and sole source of the description of the good/services you have purchased. Any images contained therein, and any external sources of information (e.g. samples and our website except for the Terms and Conditions page) are provided for the sole purpose of giving an approximate idea of the goods and/or services described and shall not form part of the contract.

3.1.5 Only a price with a stated period of validity may be taken as a quotation. For clarity, all orders placed against a quotation or otherwise are subject to our acceptance.

3.1.6 For the security of all parties once a payment is received we may conduct a variety of checks to validate the personal information you have provided with your order.

3.1.7 In the vast majority of cases we will accept your order and send you an email as confirmation; in certain circumstances we may need to contact you for further information with which to validate your details. In the rare event that we decline an order we will make a full refund of all monies paid (in the case of a PayPal processed transaction via their refund process) and notify you accordingly.

3.1.8 If, for reasons beyond our control, the requested goods/services are not available we will not supply a substitute. In this event we will discuss options with you but, of course, a full and immediate refund may be requested.

3.1.9 Goods delivered overseas may be subject to local VAT, import duty and local taxes and/or other charges. It is your responsibility to familiarise yourself with the amounts that may be due and to make the appropriate payments as demanded by the relevant authorities (please see 1.4.4 for additional costs that may apply to importing jewellery into your country).

3.1.10 The dimensions of goods (e.g. widths, depths, and sizes) are subject to tolerances that are standard within the jewellery industry.

3.1.11 All goods delivered in Britain/NI will be hallmarked by an official assay office as required by law (please note the exemption for very lightweight pieces). The quality of the precious metal used will be given by a millesimal fineness such as 750 gold or 950 platinum. Due to general familiarity we also describe gold fineness in carats. Should this be divergent it is the millesimal value that is precise and will be the grade supplied. It should be noted that our 24ct gold will be hallmarked with a fineness of 990.

3.1.12 For deliveries to all "Convention countries" items will carry "Common Control Marks" which are equivalent to British hallmarks and recognised under UK Law.

3.1.13 Where an item is constructed from different grades of a single precious metal (e.g. 750 gold and 990 gold) this will be indicated by workshop fineness marks, however, the hallmark will be for the lower of the grades present in the design.

3.1.14 Our website (www.wooltonandhewitt.co.uk) is for use only by customers aged 18 and over.

3.1.15 WOOLTON & HEWITT is owned and managed by P. Hewitt (Proprietor), 9 Lower Kings Road, Berkhamsted, Herts., HP4 2AE, UK.


3.2 Delivery Policy

3.2.1 We can deliver only to the name and address provided with your PayPal payment or as confirmed by your bank or card company. Any other arrangement must be confirmed by us in writing in advance of the order.

3.2.2 The estimated delivery period is stated on each item's information page, and should be seen as a guide only. This is our target time for manufacture. If the item is needed within 8 weeks please contact us prior to purchase and request a guaranteed delivery date.

3.2.3.1 Orders to British/NI addresses will be delivered using an insured service free of charge.
3.2.3.2 For overseas deliveries a shipping fee including in transit insurance will be payable. This fee will be specified in our quotation and order form. We reserve the right to decline to send items to some countries/locations.
3.2.3.3 For all deliveries, before dispatch, we will email you photographs of the package containing your order.

3.2.4 You agree that we may give our chosen delivery company your name, address, telephone number and email address for the purpose of facilitating delivery and, for overseas customers, also for importation and Customs related matters.

3.2.5 When receiving your order the following procedure applies:
3.2.5.1 An adult signature will be required from the person accepting the parcel at the agreed deliver address.
3.2.5.2 Before signing for the package, it should be inspected for damage or tampering. We may have provided you with images of the package as a reference point.
3.2.5.3 If necessary, the nature of the problem must be recorded on the delivery receipt. This should be done in the presence of the deliver person with a statement such as CRUSH DAMAGE TO TOP / SIDE, HOLE IN RIGHT SIDE, CORNER TORN AND TAPED BACK, OPENED IN TRANSIT AND RESEALED, INNER BOX AND CONTENTS MISSING. You also agree to immediately take photographs of the parcel and its contents and to email them to us. A video of you opening the parcel would be ideal. You also agree to provide any further details needed to support an insurance claim with the courier and/or insurance provider.

3.2.6 In the rare event that delivery is delayed or does not take place we cannot provide compensation for any actual or consequential losses.

3.2.7 Due to coronavirus (COVID-19) the Royal Mail and delivery companies may no longer capture signatures at the point of delivery. Royal Mail: "Due to the current coronavirus situation we’re no longer asking recipients to sign for items." As a consequence it is expressly agreed that ownership with risk and responsibility shall be transferred to the buyer at the moment the goods are delivered to the buyer, their partner or any apparent representative at the delivery address (for example concierge, doorman, front desk clerk, residential occupant, security guard or other functionary of the delivery location) and that this shall be evidenced by the signature of the recipient or a record of the delivery as made by the delivery person.

3.2.8 In the event that there is no one at the delivery address to which delivery can be made, it is your responsibility to arrange with the delivery company for a second delivery or personal collection and that any costs thereby arising will be at your expense.

3.2.9 In the event that an item is returned to us as undelivered we will contact the buyer to discuss re-delivery. A re-delivery fee will be payable by the buyer.

3.2.10 Any other delivery or collection method must be agreed by us in writing and in advance of the order.


3.3 Returns Policy

3.3.1 Our goods (wedding rings, engagement rings, and wedding jewellery) are made to order and therefore cannot be returned.

3.3.2 After placing an order we will contact you to confirm all the details. Once this confirmation has been given the manufacture of the pieces will start and it will not be possible to cancel your order.

3.3.3 Notification of a fault must be within 7 working days from the day following delivery. The date of delivery shall be as evidenced by the delivery company, see 3.2.7. After this period we will deem that the goods have been accepted in accordance with the order.

3.3.4 A fault is where an item supplied by us is found not to match in a material way the description we provided, not to be the size ordered given normal industry tolerances, or not to be of satisfactory quality.

3.3.5 Once we have determined that a fault exists we will refund your return delivery costs and replace or repair or re-size the item as quickly as possible. However, if the problem is found not to be a fault, for example you wish a different ring size, then all costs including the cost of returning the item will be at your expense.

3.3.6 If a manufacturing fault develops during the Guarantee period (see Section 3.5) it will be repaired free of charge and, provided prior agreement to the method of return has been obtained from us in writing, we will refund the shipping cost but noting that you retain responsibility for the item until it has been safely delivered to us.

3.3.7 We will make your rings in the sizes you order. Upon delivery if you decide that an alternative size is needed we can re-size your rings however a minimum fee will be payable in the range £50 to £100 per ring with the cost of the return being at your expense. Re-sizing after 14 days from delivery will be subject to quotation.


3.4 Payments (Domestic and Overseas)

3.4.1 We use PayPal to securely process credit and debit cards via our website. With their state-of-the-art technology your purchase is completely safe. Alternatively, you may make a bank transfer using online banking or via a bank branch. Payment for your goods/services is made when the full value in Pounds Sterling (GBP) of your Order/Invoice has been received and acknowledged by us.

3.4.2 PayPal protects your financial information with industry leading security and fraud prevention systems. When you use PayPal your card information is not shared with us (it is managed privately by PayPal and the banking system).

3.4.3 If you are located in Britain/NI using an account in Pounds Sterling there is no fee for using PayPal. For details of fees that may be charged by your bank for a transfer please contact them.

3.4.4 If you are located Overseas and/or not using an account in Pounds Sterling any and all costs associated with the payment method are for your expense. Please note that a) PayPal charges various "cross border and currency conversion fees" depending on your location, currency, and source of funds all of which are for the purchaser's account (please check your local PayPal website for details); b) fees that your bank may apply for handling the payment to us are additional and for the purchaser to pay; c) importing goods into your country may incur the additional costs of import duty, customs handling fees, VAT, and local taxes all of which are additional to our invoice and are at your expense (please check with your Customs Authority for details).

3.4.5 PayPal will send us your name, address, contact details and item information which we will use solely to confirm acceptance, make delivery and to keep you up-to-date with your order. They will not be used for marketing purposes nor will we disclose them to third parties other than the delivery company (who will pass them to Customs Authorities where necessary), and when disclosure is required by law. For further details see the PayPal policy on sharing personal information.

3.4.6.1 By prior arrangement and against a specific quotation, we may agree to accept payment in a series of scheduled part payments. Only once full payment has been made will the production of your goods commence. Part payments of this kind are refundable as long as full payment has not been made, the final part payment being your agreement to place the order, see 3.1. Should a refund be requested a reasonable deduction shall be made to cover our administration costs and, in any event, the amount returned shall not exceed the total value of the receipted part payments.

3.4.6.2 In special circumstances we may agree to start production of you items(s) before full payment has been received. In this case you are making a commitment to the purchase and to make the balancing payment(s) on the date(s) agreed with us. If you fail to make a scheduled part payment we will pause production of your item(s) and allow 48 hours for the the outstanding payment(s) to be received. After that period if the required payment(s) have still not been received we shall deem this a breach of contract on your behalf and cancel your order. We will calculate our costs and depending on the amount paid either a) offer a partial refund, or b) invoice you for the outstanding amount.


3.5 Warranty & Material Specifications

3.5.1 Although rare, allergies to metals in precious metal alloys are possible. We cannot be held responsible for the effects of an allergic reaction, please see section 3.12 for further information.

3.5.2 As required by British consumer rights law you can expect your items to be of satisfactory quality and to be fit for purpose.

3.5.3 The goods we create carry a 10 year warranty against manufacturing defects starting from the day of delivery. Expressly excluded from our warranty, but not limited to, are:

3.5.3.1 Damage to any part of the item, or the loss or damage of a diamond or other stone, caused by wear and tear (both normal and excessive), misuse, negligent handling, improper care, accidents, loss, or theft. It is noteworthy that diamonds are brittle and can be chipped and even broken, they can be scratched by other diamonds or appear scratched due to multiple tiny chips.

3.5.3.2 Scuffs, nicks, scratches, dents, blemishes, loss of surface plating (e.g. gold, rhodium and ruthenium plating) and other forms of abrasion (all of which are inevitable over time as your items are subject to normal wear and tear);

3.5.3.3 Deformation of the circular shape of rings (for example, becoming oval or twisted) as this can only be caused by external forces that are part of normal wear and tear.

3.5.3.4 Imperfections in diamonds and gem stones which occur naturally and are within the relevant colour/clarity specification are not manufacturing defects.

3.5.3.5 Repair, re-sizing, or restoration performed by someone other than us, if deemed upon inspection by us to be of sub-standard quality, shall void our warranty.

3.5.4 Our liability under our warranty shall be limited as stated in Paragraph 3.12.

3.5.5 To return an item under warranty please see 3.3 Returns Policy.

3.5.6 We inspect and test the settings of diamonds and precious stones with extreme care prior to delivery and therefore we cannot be held responsible for the loss of a precious stone unless we confirm a manufacturing defect. The settings of diamonds are subject to wear and tear and therefore should be inspected by a reputable jeweller at least every 12 months, with repairs undertaken as recommended.

3.5.7 White gold is not pure white in colour; it is an alloy of yellow gold and other metals. White gold goods may be rhodium plated to give them a completely white finish. However, rhodium plating does wear off and the colour will change over time as the underlying precious metal becomes visible. This is not a manufacturing fault and can either be enjoyed as the patina of age or the item may be restored by re-finishing and re-plating. If the use, or non-use, of rhodium plating is of importance to you please ask us to provide the relevant details prior to purchase.

3.5.8 Many ring designs, including complex shapes, diamond set rings, patterned rings, and multi-coloured rings, can only be re-sized to a small degree or not re-sized at all. To change the size you can return your ring and we will re-make it in the size required. Contact us for a quotation.

3.5.9 Before sending an item to us please obtain our agreement in the form of a Return Number or a Service Order Number. This reference is our agreement to receive and take care of your property whilst in our possession. Without prior agreement we cannot be held responsible, under any circumstances, for lost or damage to your property. You are responsible for your property up to the point of delivery to us. We highly recommend use of an insured, tracked and signed-for delivery method.


3.6 Engraving

3.6.1 The prices given on this website for engraving are based on the engraving request being placed at the time the rings are ordered, please see the Engraving page for details.

3.6.2 Should you decide on engraving after the ring has been ordered please request a quotation. The price of post-production engraving will be higher than when specified with a new ring.

3.6.3 The length and size of your inscription is subject to space being available on the rings.

3.6.4 The inscription must be supplied by email and only spelling deviations form this will be considered as a fault. Following completion, all changes or amendments to the engraving will be chargeable.
 
3.6.5 Other forms of engraving such as facsimile hand engraving can be quoted for when so requested by the customer.


3.7 Product Photographs

3.7.1 The colour of items shown in photographs on this website is indicative only. This is because, due to screen and software differences, it is not possible to obtain a true colour by viewing a website. The colour of goods supplied will vary from that shown online.

3.7.2 The size of items shown on this website is not a true reflection of actual size.


3.8 Ring Sizer Loan Service

3.8.1 Items supplied under our Ringer Sizer service remain our property and are provided on a loan basis for your use.

3.8.2 Ring sizers should be worn for no more than 30 minutes as they are made of base metal and prolonged exposure may cause an adverse skin reaction.

3.8.3 The sizers may be retained for up to 5 days and then returned in the condition supplied and with all items together.

3.8.4 Due to coronavirus (COVID-19) the Royal Mail and delivery companies do not always allow delivery signatures. The delivery person will instead log that delivery has been made. As a consequence it is expressly agreed that the sizers shall have been delivered and thus become the responsibility of the addressee at the moment a record of the delivery has been made by the delivery person or a signature obtained form the recipient.

3.8.5 A deposit for the amount shown on the ring sizer page will be requested which covers up to 2 sets of partial ring sizers. The deposit is payable by bank transfer and any related bank fees represent a cost between you and your bank.

3.8.6 If you pay the deposit from an account that is not in Pounds Sterling (GBP) please be aware that international bank fees apply and foreign currency movements mean that the deposit amount you receive back will be less than the original amount - we make no charge ourselves, this difference will be made up of various financial, exchange rate, and cross-border transaction costs.

3.8.7 Sizers for Britain/NI - We will include a prepaid return packet, you'll just need to go to a Post Office to obtain proof of posting. For clarity, if you are in the Channel Islands, the Isle of Man or a British Overseas Territory please see section 3.8.8

3.8.8 Sizers for Overseas - We ask that you purchase your rings first and then request to confirm your sizes. We will cover the cost of sending the sizers to you; you will be responsible, at your own expense, for returning them to us using an appropriate tracked and insured delivery service.

3.8.9 The date of return shall be the date of your proof of posting/carriage as supplied and confirmed by a national postal service or a reputable international courier. Upon receipt of all the items your deposit will be returned via bank transfer. You will need to provide us with your bank details so we can process the refund. After 12 months from the date of the return of our items, if you have not given us the necessary bank details, you waive our agreement for the return of the deposit and we shall deem it to be a payment for the service(s) provided.

3.8.10 We reserve the right to charge GBP £10.00 per day for the late return of our items. If the ring sizers are not returned to us within 30 days, or returned incomplete or in a damaged condition, we will recover our cost of repair or replacement by withholding your deposit and by invoicing you for the additional balance of the costs related to their replacement.


3.9 Sample Service

3.9.1 Items supplied under our Sample Services remain our property and are provided on a loan basis for your use for up to 5 days from the date of delivery or for a pre-agreed period, and then returned in the condition supplied and with all items together. Where your sizes are provided we will also supply on loan up to two partial sets of professional ring sizers.

3.9.2 The Royal Mail and delivery companies do not always allow/demand delivery signatures. The delivery person may instead log that delivery has been made. As a consequence it is expressly agreed that the samples and/or sizers shall have been delivered and thus become the responsibility of the addressee at the moment a record of the delivery has been made by the delivery person or a signature obtained form the recipient.

3.9.3 Samples allow you to see the shape and feel of a design. You may place a sample ring onto your finger to get an impression of how it looks. Our samples are not hypoallergenic and should not be in contact with your skin for more than 2 or 3 minutes. They should never be exposed to everyday activities as damage to the sample will occur.

3.9.4 Samples are made in non-precious metals and set with non-precious stones. Our sample rings are in standard sizes. They will feel lighter than items made of precious metals, but they do offer the opportunity to handle and to try on the design. The colour of the sample is indicative only.

3.9.5 Most of our collection is available as samples, however some are representative of a design theme rather than precisely as shown on the website. Contact us for details of any particular design.

3.9.6 Our Sample Service is open to couples around the world. The number of samples you may have at any one time depends on your location: GB, NI, CI & IOM = 3 samples, the EU = 2 samples, and all other countries = 1 sample. All sample requests are subject to our acceptance.

3.9.7 If you pay the deposit from an account that is not in Pounds Sterling (GBP) please be aware that international bank fees apply and foreign currency movements mean that the deposit amount you receive back will be less than the original amount - we make no charge ourselves, this difference will be made up of various financial, exchange rate, and cross-border transaction costs.

3.9.8 Samples for Britain/NI - Unless return in person has been agreed, we will include a prepaid return packet for which you will  need to visit a Post Office to obtain proof of posting. For clarity, if you are in the Channel Islands, the Isle of Man or a British Overseas Territory please see section 3.9.9

3.9.9 Samples for Overseas - We will cover the cost of send the sample(s) to you; you will be responsible, at your own expense, for returning them to us using an appropriate tracked and insured delivery service.

3.9.10 The date of return shall be the date of your proof of posting/carriage as supplied and confirmed by a national postal service or a reputable international courier. Upon receipt of all the items your deposit will be returned via bank transfer. After 12 months from the date of the return of our items, if you have not given us the necessary bank details, you waive our agreement for the return of the deposit and we shall deem it to be a payment for the service(s) provided.

3.9.11 We reserve the right to charge GBP £10.00 per day for the late return of our items. If the samples and/or ring sizers are not returned to us within 30 days of the date of delivery or the agreed return date, or returned in a partial or damaged condition, we will recover our cost of repair or replacement by withholding your deposit and by invoicing you for the additional balance of the costs related to their replacement.


3.10 Bespoke Commissions

3.10.1 For complex designs the first stage of a bespoke order is to commission a computer aided design (CAD) image which is a chargeable service. Up to three design adjustments are included as part of our CAD service. It should be noted that a major change to the design may necessitate a restart of the CAD process which would attract a separate charge.

3.10.2 We shall not be held responsible for any failure after all reasonable efforts have been made to produce an acceptable design. In the event that we are unable to produce an acceptable design, we will nonetheless be entitled to retain or receive full payment of all sums due for the CAD service provided.

3.10.3 If within six months of the CAD order the consequently designed piece is ordered the CAD service fee will be deducted from the price of the item, however if not the CAD fee covers the service provided and is not returnable.

3.10.4 The finished items will be made in accordance with the order specifications and any CAD images that have been produced. It should be noted that CAD images are not photographic and will not exactly reflect the finished item's colour, texture, reflectiveness and other visual qualities. The finished items will be deemed as complaint to specification unless we or the manufacturers agree that an error, deviation or defect has occurred.

3.10.5 Donor jewellery - If you provide us with your own jewellery or precious stones as an input to a bespoke project the following applies:

3.10.5.1 Use of your jewellery as donor material is AT YOUR RISK. Your donor items may be damaged beyond repair and/or found in the process of manufacture to be unusable.

1.10.5.2 Our examination and description of your item(s) will be solely for the purpose of identification of your property and not as a determination of its value, age, weight, dimensions, nor the identity or fineness of any stone or metal it contains. It will also not confirm ownership of or title to the item. Neither our receipt nor any other reference we make to the item shall constitute an appraisal or opinion by us as to any of the aforementioned factors.

3.10.5.3 For diamond and gem set pieces, it will be necessary to remove the stones from their settings in order to inspect them for quality, condition, weight and dimensions. It is possible that cracks or chips in your stones may be revealed or that a flaw in a stone leads to a crack or chip. Removal of your stones is done at your own risk and you agree that we shall not be responsible for the condition of nor any damage to your diamonds or gemstones as a consequence of this process. Also any subsequent re-setting of your stones in the same or a new item shall be entirely at your own risk.

3.10.5.4 Removal of the stones will inevitably result in a certain amount of damage to the settings of your jewellery. If you decide not to proceed with a bespoke commission your item will be returned with loose stones and damaged settings as a result of removing the stones. Your item(s) may be damaged further as a consequent of metallurgical testing and other preparatory work. If you decide to proceed with the new item any stones and precious metal not re-used will be returned to you in their post-removal non-wearable state.

3.10.5.5 In the unlikely event that your donor item is lost or stolen whilst in our possession we will replace it with an item of similar design and condition, or to provide compensation equal to the price you would reasonably expect to pay to buy a similar item at a British auction. For further details of our limitation of liability please section 3.12.

3.10.6 All intellectual property rights of a bespoke design including images, photographs, drawings, CAD files, and any devices or components used for its manufacture are owned by us. We reserve the right to use a bespoke design and any of its features for marketing and promotional purposes, and to produce and sell further pieces of the design.


3.11 Services

3.11.1 Requests for services (e.g. engraving, resizing, repair, restoration, and condition reports) are undertaken on the basis of "best possible" with the quality of outcome being commensurate with the best endeavours of skilled craftpersons; all Service Orders are subject to our Confirmation.

3.11.2 You will be responsible for the transportation and insurance costs associated with sending the item to us. Return delivery and insurance will be included in our Service Order/Invoice.

3.11.3 Sometimes, after the craftsperson has started work, further requirements may emerge. In this case we will inform you of the issues, provide a revised price, and seek your agreement to proceed. If you decline to continue with the necessary extra work we will return the item to you in the best possible condition given your discontinuation of the work and refund any value of the service that it has not been possible to complete.

3.11.4 We know that you love your jewellery so we'll take great care of it whilst it's in our possession. However if it were to be lost or stolen or damaged beyond repair our liability is shown in section 3.12 of these Terms and Conditions.


3.12 Liability

3.12.1 In relation to rings or other items provided by us we shall not be responsible for any damage, injury or harm caused to yourself, your property, or to any other person and/or their property. For the avoidance of doubt we expressly exclude any responsibility for the effects of allergic reactions that may be experienced to metals contained within our rings, sample rings, and ring sizers. 3.12.2 Our sole liability shall (at our option) be the replacement or repair of the item concerned or the refund of the price paid to us in respect of the item or to provide compensation equal to the price you would reasonably expect to pay to buy a similar item in similar condition at a British auction. We shall not under any circumstances be liable for any indirect, special, consequential or economic loss, loss of trade or reputation, loss of contracts, revenue, goodwill, profits or other benefits whether arising from breach of contract, negligence or otherwise howsoever. Nor shall we be liable for any sentimental or emotional value, nor any value associated with any claimed provenance or heritage. Further, we shall be under no liability to the customer for any loss related to the failure of the customer to comply with any instructions given by us whether written, via our website, or oral in respect of the item or as a result of the misuse of the item.

3.12.3 We shall (to the extent permitted by law) not be liable for any loss or damage however caused unless such loss or damaged is caused by our failure to exercise reasonable care and skill in the provision of our goods and services.

3.12.4 If it should be proven that we are liable, then such liability shall always be limited to the amount paid to us by the customer.


3.13 Force Majeure

3.13.1 We shall be under no liability whatsoever for any delay or failure in our performance or any of our obligations due to causes beyond our control including without limitation from non delivery or delays in delivery of any items due to or resulting by public health measures, war, terrorism, civil unrest, strikes, lock outs, fire, floods, explosion, government restrictions, inability to obtain materials or labour or act of nature.


3.14 Complaints Procedure

3.15 General

3.15.1 We reserve the right to amend these Terms and Conditions from time to time without prior notice. While any such changes will not be retrospective, you are advised to check these Terms and Conditions from time to time for updates.

3.15.2 No variation to these Terms and Conditions shall be effective unless in writing and signed by the parties or their authorised representative.

3.15.3 Nothing in our Terms and Conditions affects your statutory rights.
