Purchases from Woolton & Hewitt and use of our website are subject to the following sales and general terms and conditions.

Section 1: Sales Terms & Conditions

Highlights
Your rings will be made specially for you, so orders cannot be cancelled nor rings returned unless faulty.
Item descriptions (for example widths, depths and sizes) are subject to tolerances that are standard within the jewellery industry.
Our delivery targets are estimates; if you have less than eight weeks to go please ask us for a firm delivery date.
We offer free delivery to the UK. Overseas customers should check that we can deliver to your country and the cost.
Payment can be made by debit or credit card via our website, bank transfer, cash or cheque.
The decision on ring size is yours, we offer a ring sizer service and advice, a re-sizng fee will apply.
Rings of complex design, and all Carbon rings, cannot be resized; a replacement ring will be required.
Post-production engraving will be more costly than when specified with a new ring.
Your goods shall be deemed as delivered following an acceptance signature by any apparent representative at the delivery address.
It is inevitable that your rings will scratch and mark and change shape with wear as you journey through life together.
For diamond and gem set rings we recommend regular inspection of the settings by a jeweller.
Our Lifetime Guarantee covers manufacturing defects and not wear and tear.
The precise natural colour of precious metals cannot be shown accurately on a website or by a sample.
Outside of the EU customers should expect the additional cost of import duty as required by their local Customs authority.


1.1 Contract Agreement

1.1.1 All prices are per ring and shown in Pounds Sterling (GBP).

1.1.2 Please read these Terms & Conditions before clicking an "Add to Basket" button or otherwise making a purchase; completion of the online buying process, indicated by completing the PayPal payment process or making payment or part payment in any other way, will be deemed as acceptance of these full Terms & Conditions.

1.1.3 Our website (www.wooltonandhewitt.co.uk) is for use only by customers aged 18 and over.

1.1.4 All product information on our website including pricing is an invitation to treat. Orders and payments are subject to our acceptance which we signify by sending you an "Order Confirmation" email. We reserve the right to accept or decline any order (in whole or in part) at our discretion.

1.1.5 For the security of all parties once a payment is received we will conduct a variety of checks to validate the personal information you have provided with your order.

1.1.6 In the vast majority of cases we will accept your order and send you an email as confirmation; in certain circumstances we may need to contact you for further information with which to validate your details.

1.1.7 In the rare event that we cannot validate your details we will make a full refund of all monies paid (in the case of a PayPal processed transaction via their refund process) and notify you that it has not been possible to accept your order.

1.1.8 If, for reasons beyond our control, the purchased item is not available we will not supply a substitute. In this event we will discuss options with you but, of course, a full and immediate refund may be requested.

1.1.9 Items delivered to addresses outside of England, Wales, Scotland and Northern Island may be subject to local VAT, import taxes and duties, and/or other charges. It is the buyer's responsibility to familiarise themselves with the amounts that may be due and to make the appropriate payments as demanded by the relevant authorities.

1.1.10 Item descriptions (for example widths, depths and sizes) are subject to tolerances that are standard within the jewellery industry.

1.1.11 For UK customers, all of our rings are hallmarked according to UK law. For customers in Austria, Cyprus, Czech Republic, Denmark, Finland, Hungary, Ireland, Israel, Latvia, Lithuania, Netherlands, Norway, Poland, Portugal, Slovak Republic, Slovenia, Sweden, and Switzerland your rings will carry internationally recognised hallmarks. For all other overseas destinations the fineness of the precious metal will be confirmed by engraving inside each ring (however, should you wish UK hallmarks to be added please let us know at the time of order).


1.2 Delivery Policy

1.2.1 We can deliver only to the name and address provided with your PayPal payment or as confirmed by your bank or card company. Any other arrangement must be confirmed by us in advance of the order and in writing.

1.2.2 The estimated delivery period is stated on each item's information page, and should be seen as a guide only. This is our target time for manufacture and delivery. If the item is needed within 8 weeks please contact us prior to purchase and request a guaranteed delivery date.

1.2.3 To UK addresses your order will be delivered free of charge. For other countries a delivery fee will be charged, this being specified and agreed before our Order Confirmation is issued. We reserve the right to decline to send items to some countries.

1.2.4 Delivery insurance for your item will be provided.

1.2.5 In the rare event that delivery is delayed we cannot provide compensation for any actual or consequential losses.

1.2.6 The Royal Mail or courier company will require a signature on delivery. It is expressly agreed that the package shall be deemed as delivered, with risk and responsibility transferred to the buyer, following an acceptance signature by any apparent representative (for example concierge, doorman, front desk clerk, residential occupant, security guard or other functionary of the delivery location) at the delivery address.

1.2.7 In the event that there is no one at the delivery address to which delivery can be made, it is the buyer's responsibility to arrange with the delivery company for a second delivery or personal collection.

1.2.8 In the event that an item is returned to us as undelivered we will contact the buyer to discuss re-delivery noting that a delivery fee at cost will then be payable by the buyer.

1.2.9 Any other delivery or collection method must be agreed by us in advance of the order and in writing.


1.3 Returns Policy

1.3.1 Our wedding rings and engagement rings are made to order and therefore cannot be returned unless we have supplied the wrong item or the wrong size or there is a manufacturing defect.

1.3.2 After placing an order we will contact you to confirm all the details. Once this confirmation has been given your item's manufacture will start and it will not be possible to cancel your order.

1.3.3 Notification of a fault must be within 7 working days from the day following receipt. We will deem the day of receipt to be the working day following dispatch or the courier's target delivery date, unless we are notified otherwise and confirmation is provided by the Royal Mail or courier. After this period we will deem that the item has been accepted in accordance with the order.

1.3.4 A fault is where the item supplied is found not to match in a material way the description we provided, within normal industry tolerances not to be the size ordered, or not to be of satisfactory quality.

1.3.5 Once we have determined that a fault exists we will refund your return postage costs and replace or repair or re-size the item as quickly as possible. However, if the problem is found not to be a fault, for example the customer wishes a different ring size, then all costs including the cost of returning the item will be at the customer's expense.

1.3.6 If a manufacturing fault (see Section 1.5) develops at any time it will be repaired free of charge under our Lifetime Guarantee. The customer will be responsible for any carriage involved in exercising this guarantee.

1.3.7 We will make your rings in the sizes you order. If, upon delivery as defined in 1.3.3, you decide that an alternative size is needed, we can resize or remake your rings however an extra fee will be payable in the range £50 to £100 per ring. Resizing or remaking after 7 days will be subject to quotation.

1.4 Payments (Domestic and Overseas)

1.4.1 We use PayPal to securely process credit and debit cards via our website. With their state-of-the-art technology your purchase is completely safe. Alternatively, you may make a bank transfer using online banking or via a bank branch.

1.4.2 PayPal protects your financial information with industry leading security and fraud prevention systems. When you use PayPal your card information is not shared with us (it is managed privately by PayPal and the banking system).

1.4.3 For UK purchasers with an account in Sterling there is no fee for using PayPal. For overseas customers PayPal charges various "cross border and currency conversion fees" depending on your location, currency, and source of funds. Please check your local PayPal website for details. Once your payment is complete PayPal will automatically notify us and email you a receipt. For fees that may apply to a bank transfer please check with your bank. Following a bank transfer we'd appreciate an email to confirm that a payment has been made.

1.4.4 PayPal will send us your name, address, contact details and item information which we will use solely to confirm acceptance, make delivery and to keep you up-to-date with your order. It will not be used for marketing purposes nor will we disclose it to third parties. For further details see the PayPal policy on sharing personal information.

1.4.5 Payments may also be made by cash or cheque. Just let us know which method you prefer.

1.4.6 By prior arrangement and against a specific quotation, we may agree to accept payment in a series of scheduled part payments. Only once full payment has been made will the production of your rings commence. Part payments of this kind are refundable as long as full payment has not been made (the final part payment is your agreement to place the order under our usual contract agreement terms, see 1.1). Should a refund be requested a reasonable deduction shall be made to cover our administration costs and, in any event, the amount returned shall not exceed the total value of the receipted part payments.


1.5 Material Specifications & After Sales Service

1.5.1 As required by UK consumer rights law, you can expect your items to be of satisfactory quality and to be fit for purpose.

1.5.2 Each ring comes with a Lifetime Guarantee covering manufacturing defects; expressly excluded from this Guarantee are, but not limited to:

1.5.2.1 Damage to any part of the ring, or the loss or damage of a diamond or other stone, caused by wear and tear (both normal and excessive), misuse, negligent handling, improper care, accidents, loss, or theft. It is noteworth that diamonds are brittle and can be chipped and even broken, they can be scratched by other diamonds or appear scracthed due to multiple tiny chips.

1.5.2.2 Scuffs, nicks, scratches, dents, blemishes, loss of gold, rhodium and ruthenium plating, and other forms of abrasion (which are inevitable over time as your rings are subject to normal wear and tear);

1.5.2.3 Deformation of the circular shape (for example, becoming oval or twisted) as this can only be caused by external forces that are beyond our control.

1.5.2.4 Imperfections in diamonds and gem stones which occur naturally and are within the relevant colour/clarity specification are not manufacturing defects.

1.5.2.5 Repair or restoration performed by someone other than Woolton & Hewitt, if deemed upon inspection by us to be of sub-standard quality, will void our Guarantee.

1.5.3 Our liability under our Guarantee will be limited as stated in Paragraph 1.11.

1.5.4 To return an item under Guarantee please see our Returns Policy in Paragraph 3.

1.5.5 We inspect and test the settings of diamonds and precious stones with extreme care prior to delivery and therefore we cannot be held responsible for the loss of a precious stone unless the manufacturer confirms a production defect. The settings of diamonds are subject to wear and tear and therefore should be inspected by a reputable jeweller at least every 12 months, with repairs undertaken as recommended.

1.5.6 White gold is not pure white in colour because of the intrinsic yellow colour of gold. Some of our white gold items are rhodium plated to give them a completely white finish. Rhodium is a precious metal. Grey gold is not fully grey so to produce a dark colour it is ruthenium plated. Ruthenium is a precious metal. However, rhodium and ruthenium plating does wear off and the colour of the white or grey gold will over time change as the underlying colour becomes visible. This is not a manufacturing fault and can either be enjoyed as the patina of age or the item may be restored by re-plating. If the use, or non-use, of rhodium or ruthenium plating is of importance to you please ask us to provide specifications for the ring(s) that you are interested in prior to purchase.

1.5.7 Some ring designs, including complex shapes, illusion tension set rings, patterned rings, and multi-coloured rings, can only be re-sized to a small degree or not re-sized at all. Carbon fibre rings (Carbon Collection) cannot be resized. Upon request we can provide a quotation to make a replacement ring for you in the new size.

1.5.8 Before sending an item to us you must obtain our agreement in the form of a Return Number or a Service Order Number. This reference is our agreement to receive and take care of your property whilst in our possession. Without prior agreement we cannot be held responsible, under any circumstances, for lost or damage to your property. You are responsible for your property up to the point of delivery to us. We highly recommend use of an insured, tracked and signed-for delivery method.


1.6 Engraving

1.6.1 The prices given on this website for engraving are based on the engraving request being placed at the time the rings are ordered, please see the Engraving page for details.

1.6.2 Should you decide on engraving after the ring has been ordered please request a quotation. The price of post-production engraving will be higher than when specified with a new ring.

1.6.3 The length and size of your inscription is subject to space being available on the rings.

1.6.4 The inscription must be supplied by email and only spelling deviations form this will be considered as a fault. Following completion, all changes or amendments to the engraving will be chargeable.
 
1.6.5 Other forms of engraving such as facsimile hand engraving can be quoted for when so requested by the customer.


1.7 Product Photographs

1.7.1 The colour of items shown in photographs on this website is indicative only. This is because, due to screen and software differences, it is not possible to obtain a true colour by viewing a website. The colour of item supplied will vary from that shown online.

1.7.2 The size of items shown on this website is not a true reflection of actual size.


1.8 Ring Sizer Loan Service

1.8.1 Items supplied under our Ringer Sizer service remain the property of Woolton & Hewitt and are provided on a loan basis for your use, and that of your partner.

1.8.2 A signature will be required on delivery. The sizers may be retained for up to 5 days.

1.8.3 For sizers being delivered within the UK a deposit for the amount shown on the Ring Sizer page will be requested which covers up to 2 sets of partial ring sizers. We'll include a pre-paid return packet, you'll just need to go to a Post Office to obtain proof of posting. Upon receipt of all the items your deposit will be returned in full via a PayPal refund. For clarity the UK does not include Crown Dependencies nor BOTs.

1.8.4 For sizers being delivered Overseas we ask that you purchase your rings first and, at that point, request to confirm your sizes. At your expense, the sizer kit should then be returned using an appropriate tracked delivery service.

1.8.5 If the ring sizers are not returned to us, or returned incomplete or in a damaged condition, we will recover our cost of repair or replacement by withholding your deposit and by invoicing you for the balance of our out-of-pocket expenses.


1.9 Sample Service

1.9.1 Items supplied under our Sample Services remain the property of Woolton & Hewitt and are provided on a loan basis for your use for up to 5 days from the date of delivery. Where your sizes are provided we will also supply on loan up to two partial sets of professional ring sizers.

1.9.2 Samples are made in non-precious metals and set with non-precious stones. They are made in standard sizes. They will feel lighter than rings made of precious metals, but they do offer the opportunity to handle and to try on the design. The colour of the sample is indicative only.

1.9.3 Many of our rings are available as samples, but not all. We constantly add new ones to our sample range. For some collections we offer a sample that is representative of a design theme. This will be stated in the "Order a sample of this ring" section.

1.9.4 Our Sample Service is open to people with postal addresses in the UK, the rest of the EU and many other countries. You may have up to 4 samples at any one time. Orders for samples are subject to our acceptance.

1.9.5 Samples and ring sizers should be returned not later than 5 days from the date of delivery. They should be in the condition supplied and with all items together. Returns from the UK can be made using the pre-paid packet supplied, you will just need to go to a Post Office to obtain proof of posting. Overseas customers will need to pay for the return themselves sending our items via an appropriate tracked delivery service. Upon receipt of all the items, your deposit will be returned in full via a PayPal refund. For clarity the UK does not include Crown Dependencies nor BOTs.

1.9.6 The date of return shall be the date of your proof of posting/carriage as supplied and confirmed by a national postal service or a reputable international courier.

1.9.7 We reserve the right to charge GBP 10.00 per day for the late return of our items. If the samples and/or ring sizers are not returned to us within 20 days of the date of delivery, or returned in a partial or damaged condition, we will recover our cost of repair or replacement by withholding part or all of the deposit and by invoicing you for the balance of our out-of-pocket expenses.


1.10 Bespoke Orders

1.10.1 All our other terms and conditions apply to bespoke orders with the specific addition of those listed in this section.

1.10.2 For complex shapes the first stage of a bespoke order is to commission a CAD design which is a chargeable service. A reasonable number of design amendments are included as part of our CAD service. It should be noted that a major change to the design may necessitate a restart of the CAD process which would attract a separate charge.

1.10.3 We shall not be held responsible for any failure after all reasonable efforts have been made to produce an acceptable design. In the event that we are unable to produce an acceptable design, we will nonetheless be entitled to retain or receive full payment of all sums due for the CAD service.

1.10.4 When an order is placed with us for the item that is the outcome of the CAD service, the CAD service fee will be deducted from the price of the item(s); if an order does not result from the CAD service then the CAD fee covers the service provided and is not returnable.

1.10.5 The finished items will be made in accordance with the order specifications and any CAD images that have been produced. It should be noted that CAD images are not photographic and will not truly reflect the finished items' colour, texture, reflectiveness and other visual qualities. The finished items will be deemed as complaint to specification unless we or the manufacturers agree that an error, deviation or defect has occurred.

1.10.6 All intellectual property rights of a bespoke design including images, photographs, drawings, CAD files, and any devices or components used for its manufacture are owned by Woolton & Hewitt and/or our manufacturing partners. We reserve the right to use a bespoke design and any of its features for marketing and promotional purposes, and to produce and sell further pieces of the design.


1.11 Liability

1.11.1 Our sole liability shall (at our option) be the replacement or repair of the item concerned or the refund of the price paid to us in respect of the item concerned. We shall not under any circumstances be liable for any indirect, special, consequential or economic loss, loss of trade or reputation, loss of contracts, revenue, goodwill, profits or other benefits whether arising from breach of contract, negligence or otherwise howsoever. We shall be under no liability to the customer for any loss related to the failure of the customer to comply with any instructions given by us whether written or oral in respect of the item or as a result of the misuse of the item.

1.11.2 We shall (to the extent permitted by law) not be liable for any loss or damage however caused unless such loss or damaged is caused by our failure to exercise reasonable care and skill in the provision of our goods and services.

1.11.3 If it should be proven that we are liable, then such liability shall always be limited to the amount paid to us by the customer.


1.12 Force Majeure

1.12.1 We shall be under no liability whatsoever for any delay or failure in our performance or any of our obligations due to causes beyond our control including without limitation from non delivery or delays in delivery of any items due to or resulting by war, terrorism, civil unrest, strikes, lock outs, fire, floods, explosion, government restrictions, inability to obtain materials or labour or act of nature.


1.13 Complaints Procedure

1.13.1 In the unlikely event that you wish to make a complaint please send full details in writing to Woolton & Hewitt, 9 Lower Kings Road, Berkhamsted, Hertfordshire, HP4 2AE.


1.14 General

1.14.1 We reserve the right to amend these Terms and Conditions from time to time without prior notice. While any such changes will not be retrospective, you are advised to check these Terms and Conditions from time to time for updates.

1.14.2 Nothing in our Terms and Conditions affects your statutory rights.
 

Section 2: General Website Terms & Conditions

2.1 You acknowledge that all intellectual property rights, including any trade marks or copyright in the content of this website, are owned by us (Woolton & Hewitt) or our third party suppliers and partners. Nothing contained herein shall be construed as granting any licence or right to use any of our intellectual property except where expressly stated in writing.

2.2 Material may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way unless written permission is granted by us.

2.3 You agree to use this website only for lawful purposes and in a manner which does not infringe the rights of or restrict or inhibit the use of or enjoyment of this website by any third party.

2.4 We reserve the right to suspend or terminate your registration to any free services that may be provided by us, for example our newsletters, at our sole discretion and without notice.

2.5 You agree to indemnify, hold harmless and defend us from any and all loss, damage and expense (including legal fees) incurred by us on account of any claim or lawsuit arising out of or related to your use of this site.

2.6 You accept that when you leave this site (whether knowingly or not) we can no longer be responsible in any way for any material that you encounter and we exclude (to the fullest extent permitted by law) any liability that may arise with respect to or as a result of such material causing any damage, costs, injury or financial loss of any kind.

2.7 We use reasonable care and skill in providing the content on this website but we cannot guarantee the accuracy, timeliness, completeness or suitability of the content. Some content may contain pricing information, however such pricing should be taken as indicative and may not be replied upon and is expressly not a quotation for the provision of the related goods or services.

2.8 In line with the needs of persons with different abilities, and with the Disability Discrimination Act (DDA), we have taken all reasonable actions to make this website accessible. All key information provided on this website may also be obtained in print or via a telephone discussion upon request.

2.9 We will not be liable for any claims, losses, including but not limited to direct, indirect, special, economic and consequential loss or damage (including but not limited to loss of profits, loss of revenue or loss of goodwill), whether in contract, negligence or other tortious action arising out of or in connection with the use of this site.

2.10 All of our Terms and Conditions are governed by and will be interpreted in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts.

2.11 Although we have taken all reasonable care to ensure that that your use of this website is pleasurable, we do not warrant that this website is free of viruses or bugs or that this website is compatible with all computer systems and browsers types and versions.

2.12 This website may include links to other sites on the world wide web. We make no warranties as to the suitability or accuracy of the content of any of those websites.
